We do not warrant that the Services will be uninterrupted, secure, or error-free. We do not guarantee the accuracy or reliability of any results obtained through the use of our Services.
6Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EYMEL LLC AND ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Eymel LLC's total aggregate liability arising from all claims shall not exceed the amount paid by you for the Services during the twelve (12) months preceding the event giving rise to such liability.
7Indemnification
You agree to indemnify, defend, and hold harmless Eymel LLC, its directors, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your breach of these Terms, misuse of the Services, or violation of any third party's rights.
8Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. Any disputes that cannot be resolved through negotiation shall be subject to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming.
The parties agree not to contest the jurisdiction of such courts and waive any defense of improper venue.
